....fell on the missus (who is 6 months pregnant) and my daughter, aged three, in the supermarket the other day.

They were stacked up to head height in soggy cardboard boxes which gave way as we walked by. Picture 100 liter sized bottles of beer hitting the deck and exploding everywhere with SO and child in the middle of it.

The missus had a small puncture wound on the back of her leg which flowed (vein), as well as other cuts and scrapes. Littl'un fine but now scared to go to the shops. All in all a lucky escape, it could have been a lot worse.

I had to patch the missus leg up myself from my own 1st aid kit because the supermarket 1st aider had neither the knowledge nor the kit to treat a sliced vien. The Supermarket manager later claimed that his staff did this.

What to do?

1) Go all the way, report it, sue the ****ers in the hope that they change their practices; also train and equip their 1st aiders.

2) Put it down to bad luck and walk on by.

Option 1. No question.

It will be interesting to find out whether the accident reporting forms have been filled out properly, too...

Glad the family is ok and no good beer was harmed in the accident 😉

I'd be going down the option 1 route.

Write to their head office and solicit their comments.

If it was a major supermarket it will be worth while following this up. Try to get hold of the regional manager etc.

Its a major supermarket chain.

No forms at the time. A guy ran out to the car park and got our number as we were leaving but it was an afterthought.

We registered a complaint at the Head office; they keep calling us but its more fishing for information, telling us nothing really happened and silence than anything else. Really bizarre phone calls, kinda like being on the phone to Derran Brown.

We also made a report at the Guardia Civil, who are giving us the nudge to take it further. Not the first accident in this chain apparently.

I don't want an ipod or any money. Just a little responsibility.

Thanks for the replies.

I would be hitting them for everything - why should they think they can get away with this?

Have you any (independent) witnesses?

1. Without question. And I'd be calling the Health and Safety Executive right away. Oh, maybe not if it's in Spain

The H&S laws are actually pretty strict here, all EU derived. Things have moved on from deathtrap hire cars and collapsing hotel balconies.

The Guardia were saying to us. "There are rules and laws they need to follow and in this case they havent followed them, so you should pursue it other wise they will get away with it and nothing will ever change".

Right this is what you do.

DO NOT SPEAK TO THE SUPERMARKET until you've been to see a solicitor and started proceedings. The supermarket will know full well what happened and will know full well what they 'should' have done. Talking to you know will be a sifting exercise to get info that aids their defence. Ignore their calls.
