I have a Haro BMX which is now 8months old. Noticed a strange noise from the front hub last week, and found that the axle can be move from side to side (about 0.5-1mm), yet the lock nuts (it uses cartridge bearings) are tight. So it seems like the axle has been made incorrectly ie slightly too wide, and also it seems that the bearing seats on the hub may have worn as the bearings should never pop in and out that easiley.
Raised the matter with the shop where it came from - they contacted the Haro importer, Moore and Large. They are saying tough basically as 'Haro BMX wheels only have a 30 day warranty'! I was never aware of this and the shop wasn't either.
How do I stand with this, in a legal sense?
legs extended and shoulder width apart is normally most comfortable for me
Warranty - how do I stand - Trousers down, legs apart and bent over. Looks like the bike shop is going to bugger you up anyway, might as well get ready
Warranty do not affect your rights when it comes to faulty products. if you beleive the item is faulty and should last longer than 8 months then it is up to the retailer to prove it was fit for purpose at the point of sale.
Bearings wear, such is life.
As highclimber says, this is comes under consumer law and faulty goods. I believe a warranty means that they guarantee that a 'non faulty' product will be free of issue for 30 days.
The retailer could argue that you've used the bike for 8 months therefore have accepted the goods...he could replace the bearings for you but I don't think they're required to.
As mrmo says bearings wear, so the retailer could argue that it is expected to happen.
If there's an irrepairable fault that caused them to wear then you have grounds for a refund I think.
Disclaimer: I have no legal background, only an internet connection, therefore I am an expert in all things.
Re the 'How do I stand' question...this depends on alcohol intake - this can often affect ability to stand.
Its poor for the retailer to not know the warranty of the product they sell. they should have a fair wear and tear warranty for the goods they sell if they are a reputable retailer. they should at least investigate what is causing the problem.
Its all what is fair really, if you have not used the item all too much and you feel it should have lasted longer then the retailer should investigate this.
It would be unreasonable (though not uncommon) for a consumer to bring an product back, out of warranty and well used and expect a refund or replacement on the spot. If you are reasonable with them they will generally be very helpful if they are looking to keep your custom.
HTH
As I understand it, after 6months from date of purchase the seller can ask you to deal direct with the importer/manufacturer.
Crotchrocket - no.
Your contract is with the retailer under sale of goods act. Nothing to do with the importer or manufacturer
However bearings are wear and tear items so I think you will be hard pushed to show that yor rights under SOGA apply
Don't confuse warrenty which is over and above your rights under soga and is discretionary with your rights under SOGA

Basic contract law, your contract is with your seller and no one higher up the chain need to speak to you. Personally I would just accept bearings wear out and get on with life. Life is to short to be winging about bearings wearing out.
Yeh, similar thing happened to me with my bmx.
I'd been riding it quite a bit and after 8 months I noticed the tyres had alot of wear to them (mainly due to me pulling rad skids, but i didnt tell the shop that!)
I took it to the shop and they told me that these things wear out and that they wouldnt cover it! WTF
