Just got a rather interesting tale relayed to me by my wife, I'll leave a link for the full details:

Basically the woman bought a bike advertised as last years model but new. Turns out its a 2019 that has been raced by a member of staff and had numerous bits replaced. But since they are staff it's still technically new?!? I'm leaving this here as more as a buyer beware warning to others in the area, IMO they are just ripping her off.

Outrageous. I'd have a chat with the sales manager. If not satisfied with the outcome (esp. regards to the warranty) I'd be in touch with Trading Standards and with Head Office.

'national bike shop chain' not named in link but the price eliminates halfords.
OP makes clear it's Giant; they don't have many stores in Lincolnshire so I'm guessing it's Doddington Hall.
Suggest the 'angry customer' contacts James Birch, chairman of Giant Lincoln; lives at Doddington Hall - his wife owns it.
Don't really see it as caveat emptor.
Is the 'angry customer' happy with the bike?
What would it take to make her less angry?
Bit of a 'non post' really.

'Angry customer' could take a lead from geordiemick00 in pursuing legal resolution...Ling's Cars and, now, his current obsession - a flooring supplier.
Lincolnshire trading standards for misleading description/misrepresentation but they're massively understaffed so no progress there.

I suppose it comes down to the definition of 'new'. Are all the consumable parts new, and is the warranty intact? That its a previous years model isn't relevant I don't think, it's not law to reduce the price of a previous years model (and they did reduce the price)

plus with all the other supply/demand issues, I'd say she's done alright, and got a race winning bike.

Yeah, bit naughty to say the least. By all means sell it as race winning etc but you should inform the new buyer of its history so they can make an informed choice. Pure rule 1 stuff.

Imagine listing out on eBay. Would a good seller neglect to state the bikes history? Nope.

If the bike is actually "ok" a far as the new owner is concerned id try for a big discount to reflect the fact it has been used and used hard.

"Ride it like you stole it hard" in fact.

I tried to register it with the manufacturer yesterday on their registration scheme and can’t register it as it’s already registered

The fact it can't be registered on the manufactures site would be a big,big concern for me too. That's a lot of money to pay for a bike that may or may not have warranty. Again, the buyer should have had that info from the seller.

Other than that a refund.

Oh man, the Ling thread. I still have panic attacks over that. Those search and destroy gifs...

^^ Sorry Tom, you are correct of course.

Extended warranty (over and above the statutory) is still with the manufacture though and not necessarily honoured by the lbs? That would still concern me as the buyer.

the tale is utterly bang out of order. Newspapers and HQ of the company. Get a proper discount on the bike

Which is only an issue if the warranty offers more than the legal minimum, or the shop is not willing to offer that difference/extra. Which we don’t know.

So you think a shop selling a bike as new but actually raced for two years is fair? Have you actually bothered reading the thread beyond the first post?

As for retailer warranty or such, if they can't be trusted to tell the truth about the bikes history what makes you think they would honour any warranty issues or resolve any complications brought by the fact she's actually the second owner and its already 2 years into its warranty?

She appears to have caved and accepted a few vouchers off them. The idea that a bike raced for 1000 miles or more could be still be a 'new' bike is an exceptional piece of bullshit. Buying a 'race-winning' bike doesn't mean I want the actual bike that won the race! They even mentioned that the shifter was replaced because it was 'scuffed', which doesn't exactly rule out the possibility that it's been crashed at some point.

Would definitely be spreading the tale around the Road.cc and other forums.
