So, I work from home. Went into office yesterday, called in by my boss who then tells me that they are bringing in all work in house & making me redundant.
OK. He then pulls out a letter obviously pre written which says "further to our meeting of the 12/08/09 I am writing to confirm the outcome of the redundancy consultation with you" (what consultation)

It then says "In consultation with you we offered you the opportunity to make suggestions on how the proposed redundancy could be avoided but have not received any suggestions as to how to avoid a redundancy situation with your job" News to me as the letter was clearly written before I even knew about it.

So being made redundant on friday 14/08/09

I can't get over the fact that they had it all pre written before it was ever mentioned to me

Must update CV this morning

Sounds to me like they've left themselves wide open to all sorts of claims against them.

Are you permanent staff? How long have you been there, how many people are being made redundant?

If I were you I'd fire off an email right now to your boss and cc in your HR dept and make clear that you were never consulted (since this is a requirement) or given the opportunity to provide any alternative suggestions.

You're also entitled to at least your notice period before being made redundant.

That sounds illegal, not just underhand. Put the frighteners on them a ittle bit and at least get them to pay your notice period.

Get yourself to the CAB as soon as possible - that all sounds very dodgy.

You've not had a consultaion in line with the letter handed to you. I'd be contesting this one. I think the consultation period varies according to how many people work for the company/are affected. I'd seek some advice form a professional and pronto!

Good luck

Well you're perm and over 2 years so you're in a decent position though won't get much of a payout if they only do statutory.

Lots of info here:
http://www.roydens.co.uk/content37.htm

If you're the only redundancy, they don't have to do a consultation.

Selection for Redundancy

The criteria used to select employees for redundacy should be as objective as possible. Consider last in first in (“LIFO”), skills and performance, attendance and disciplinary record, experience and aptitude. Consider whether each criterion should have equal weight
In considering the pools from which employees will be selected for redundancy, consideration must be given to the type of work carried out by the employees including whether jobs are interchangeable, whether other groups of employees are doing similar work to those in the group from which selection is proposed to be made and whether an employee’s inclusion in a pool is consistent with his or her previous position
The employer must then ensure that the individuals chosen to make the selections for redundancy are properly capable of assessing the individuals in the pools for selection and ensure that they have been given guidance on how to apply the selection criteria.

Do you do a similar job to others (in which case you'd have been in a pool) - if you, ask to see your scoring (you have a legal right to this) and also ask to see the criteria used.

that's almost word for word exactly the letter I got. its clearly a copy / past job from the "getting rid of people" hand book.

Which is perfectly fair (unfortunate as it is). Making things up (the meeting on 12/8/09) is not.

It's not the act or letter itself, it's the way it's been done. The letter was obviously written before they even talked too me about it.
I would have thought that they should have asked me if I was prepared to work in the office & if I had said yes, then if the redundancy was still required (for other reasons) a pool established.

I need to speak to the CAB or someone. I need some bargaining chips

I've had to deliver the bad news to 6 people over the last 6 months so I know for certain that your employers have made a right pig's ear of that.

Tear into them where possible.
