Give most of us buy our various bits n bobs of an errrm, 'specialist nature' by mail order now, a lot of the Companies provide return services as part of their offering. That being the case, who carries the risk of the item going missing if it's returned via the sellers carrier?

Ta.
The onus is on the person that sends it IMO, whether it's the sellers carrier or not.
Its your responsibility. Always get proof of delivery or even insurance if returning items of any value. that way you pass risk onto the courier or PO.

I'd have thought the contract was between seller and courier in that case, if they're the ones who hired the carrier to handle the return

Eggzackery. That's where I am even though it theoretical at this stage. He who retains the courier/carrier has the liability for their performance unless it says otherwise in the T's&C's?
A lot of the big players refund on courier receipt confirmation during return i.e. before the item has even left the courier's local premises...
In that case you could just not put the item in the box and send an empty box with the returns label on there? There has to be some responsibility on the senders side surely?

Well yes, the responsibility is on you not to commit fraud.
The delivery of the *package *is the contractors problem not specifically the sender. If the package is damaged out lost, their courier, their problem. If the package is empty sent that way, very much your problem.
That said I don't suppose the OP is posting here because he returned an empty box to love honey & they're contesting that the "hole" he he returned isn't the faulty fleshlight he claimed to be sending back and he's now trying to pin it on their courier. I may be wrong though.
Errrm, busted! 😝 Luckily I don't know what any of those things are. This is just a routine return to one of the regular mail order jobbies. Nothing sinister (or rude 🙃)

I work in the e-commerce industry and there are many different models for retuning goods. The basic rule is ‘if you pay for shipping you own it’. Basically if I buy something, don’t like it and pay for it to be returned I have the contract with the transport company and a duty of care to get it back to the seller. It I was returning something and the seller was paying for the shipping/collection you only need the receipt of collection/shipping from the transport company you have no responsibility or ownership of duty of care for the returned goods.
You're right though,it's very exciting!
@terry27 Thankyou. I worked in ecomm but it was limited to whipping Majento devs into shape not contractual...
@nobeerinthefridge At least you know where you'll stand when you return your low mileage/never raced or rallied Black Invader...
