Would it be fair for a trek dealer to quote their own terms and conditions amd use them as a reason not to honour it?

Its a pair of tyres where the packaging is clearly marked with the Bontrager Unconditional Guarantee logo.
One of the tyres is misshapen and unuseable, couldnt tell until fitted. I asked about sending them both back and received a curt reply with their terms and conditions about how things have to be unused etc.
Shop says no, but trek say yes?
Tell trek the shop say no, pretty sure trek will 'have a word'
I have referred the shop to the guarantee as linked above and asked them for a response.
My take is, unconditional is unconditional. I.e. it doesnt matter why I am not happy.

I don't think the 'unconditional guarantee' needs to come into it. If you can't tell whether a tyre is faulty/sits right until you fit it, then it's unreasonable for you to magically notice before it comes out of the packaging. As long as you haven't ridden a 50 mile loop on it, it's just defective goods, and the usual consumer rights apply. The shop is taking the piss.

The faulty tyre is covered by the sales of goods act since from your description on the other thread it isn't fit for purpose. I'm not sure that you could return the second tyre since it appears from your comment that it is fine.
It may be your desire to return both that the shop has problem with.

Thats where the Unconditional Guarantee comes in which is offered by Trek on their products and is linked to in the original post.

Seems pretty clear it covers things that have been used/tried.

TBF there are conditions, it's applicable to after market products only, you're going to need a receipt, you have 30 days from purchase and it has to be cleaned first...

It's faulty. The guarantee is totally irrelevant in this. Shop are ****s.
LBS had somebody in wanting a HR2 for a trip abroad urgently, they had SE4 or 5 (cannot remember which) which are a bonty equivalent for the HR2. He huffed and puffed and took it but wasn't happy as all his mates were on HR2's. He ragged it on his holiday and then spent a few weeks smashing local strava segments then brought it back with a few days to go saying he wanted his money back.
LBS owner asked why
"it's not a HR2".
So he got his money back.
LBS owners comment:
"baa"
The SE5 is better than the HR2 so maybe he'll be back for it in a few weeks 😆
